ABOUT THESE TERMS
This website and online store (the Site) is operated by Falsum Pty Ltd (trading as Quest Coffee Roasters) (we, us, our). These Terms of Service (the Terms) govern your access to and use of the Site and any purchase of products or services from the Site.
By accessing the Site or placing an order, you agree to these Terms, and to any additional policies referenced in these Terms (including our Shipping Policy, Returns Policy, and Privacy Policy) (together, the Policies).
If you do not agree, you must not use the Site or purchase from the Site.
1. DEFINITIONS
ACL means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Products means goods offered for sale on the Site (including coffee beans and related items).
Subscription means a recurring purchase arrangement for Products (including any “roaster’s choice” style rotation where offered).
You means the person using the Site or purchasing Products.
2. ELIGIBILITY & ACCEPTABLE USE
2.1 You must be at least 18 years old (or have the consent of a parent/guardian) to place an order.
2.2 You must not use the Site or Products for any unlawful purpose or in a way that breaches any applicable law.
2.3 We may suspend or restrict access to the Site if we reasonably believe you have breached these Terms or misused the Site.
3. YOUR ACCOUNT & INFORMATION
3.1 If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activity under your account.
3.2 You agree to provide current, complete and accurate information (including delivery address, email, and payment details).
3.3 You must promptly update your details so we can process your orders and contact you if required.
4. ORDERS (GENERAL)
4.1 Order acceptance: Your order is an offer to purchase. We may accept or decline an order (for example, due to stock availability, suspected fraud, pricing errors, or delivery limitations). If we decline an order after payment has been taken, we will refund the amount paid for the unfulfilled order.
4.2 Order changes: Once an order is submitted, changes may not be possible. If you need help, contact us as soon as possible and we’ll do our best to assist.
4.3 Limits: We may impose reasonable limits per order/household/customer where necessary (for example, for limited releases).
5. PRICING, GST, PROMOTIONS
5.1 Currency & GST: Unless stated otherwise, prices are in AUD and include GST. Delivery fees (if any) are shown at checkout.
5.2 Price changes: We may change prices from time to time. Price changes will not affect orders already confirmed and paid, except to the extent needed to correct a genuine pricing error (see clause 10).
5.3 Online-only offers: Some Products, bundles, discounts or promotions may be available online only, and may be limited in quantity or time.
5.4 In-store programs: Unless we expressly state otherwise, online orders are not eligible for in-store-only promotions, loyalty programs or benefits offered at physical Quest Coffee Roasters venues.
6. COFFEE SUBSCRIPTIONS
6.1 Recurring billing authority: When you purchase a Subscription, you authorise us (and our payment processor) to charge your selected payment method for each recurring order (including applicable delivery fees) until your Subscription is cancelled in accordance with these Terms.
6.2 Subscription schedule & processing: Subscription processing dates and frequencies depend on the option you select at checkout and the settings available in your account. If your platform allows, you can manage upcoming orders through your account; otherwise, contact us.
6.3 Changing your Subscription (cut-off): Changes to your Subscription (including address, quantity, frequency, or product selection) must be made before the cut-off time shown in your account (or, if no cut-off is shown, at least 3 business days before the next scheduled processing date). Changes requested after the cut-off may apply to the following cycle.
6.4 Price changes to subscription Products: Subscription prices are based on our standard pricing. If the standard price of a subscribed Product changes (or delivery costs change), your Subscription price may also change. Where a change will affect your next scheduled charge, we will take reasonable steps to notify you in advance (for example by email and/or account notification). You may cancel before your next scheduled charge if you do not wish to continue.
6.5 Changes to Subscription options / discontinuation: We may add, remove, or change Subscription options (including frequencies or product availability) from time to time. If we discontinue a Subscription Product you are subscribed to, we may (acting reasonably) do one of the following:
- offer you an alternative Product of similar value (including a similar roast/profile),
- skip a delivery (and not charge for that skipped delivery), or
- cancel the affected Subscription and refund any amount paid for any undelivered order.
6.6 Roaster’s choice / substitutions: If you select a “roaster’s choice” or rotating option, you acknowledge that the Product delivered may vary from cycle to cycle. Where a specific Product is unavailable, we may substitute with a comparable Product.
6.7 Failed payments: If a recurring payment fails, we may retry charging your payment method. If payment cannot be processed, we may pause, skip, or cancel the Subscription (and we may contact you for updated payment details).
6.8 Our right to cancel or suspend: We may suspend or cancel a Subscription if we reasonably suspect fraud, misuse, or a material breach of these Terms, or if we are unable to fulfil deliveries to your nominated address.
6.9 Your right to cancel: You can cancel a Subscription at any time. Cancellation will apply to future orders that have not yet been processed (see clause 6.3).
6.10 Sign-up fees / first order pricing (if applicable): If a sign-up fee (or different first-cycle pricing) applies, it will be disclosed at checkout. Where a sign-up fee is used to offset an initial discount, discounts apply only as described at checkout.
7. SHIPPING & DELIVERY
7.1 Delivery and pickup terms are set out in our Shipping Policy (including dispatch timeframes, carriers, and any pickup conditions).
7.2 You are responsible for providing a correct delivery address and delivery instructions. If an order is returned to us due to an incorrect address or failed delivery attempts, you may need to pay a re-delivery fee (where applicable).
7.3 Delivery timeframes are estimates only and may be affected by factors outside our control.
8. RETURNS, REFUNDS & CONSUMER GUARANTEES
8.1 Our voluntary change-of-mind returns (if any) are set out in our Returns Policy.
8.2 Australian Consumer Law: Our goods come with guarantees that cannot be excluded under the ACL. You may be entitled to a repair, replacement, refund and/or compensation where goods fail to meet consumer guarantees.
8.3 Nothing in our Policies (including any time limits for voluntary returns) limits your rights under the ACL.
9. THIRD-PARTY TOOLS, SERVICES & LINKS
9.1 We may use third-party platforms (for payments, subscriptions, shipping, analytics, etc.). To the extent permitted by law, we are not responsible for third-party outages or faults outside our control.
9.2 The Site may contain links to third-party websites. We do not endorse and are not responsible for third-party content, products or services.
10. ERRORS, INACCURACIES & PRICING MISTAKES
10.1 We try to ensure all information is accurate, but occasionally there may be errors (including pricing, descriptions, promotions, shipping charges, or availability).
10.2 If we identify an error relating to your order, we may (acting reasonably) correct it, cancel the order, or contact you to reconfirm the order at the correct price. If we cancel, we will refund any amounts paid for the cancelled order.
11. USER CONTENT
11.1 If you submit reviews, comments, or other content, you:
- warrant you have the right to submit it, and it does not infringe others’ rights, and
- grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and publish it for operating and promoting our business.
11.2 We may moderate or remove content that is unlawful, offensive, misleading, or otherwise inappropriate.
12. PRIVACY
Your submission of personal information through the Site is governed by our Privacy Policy.
13. PROHIBITED CONDUCT
You must not:
- interfere with the Site’s security or functionality,
- scrape, crawl or use automated means to harvest data (except as permitted by law),
- upload malicious code,
- impersonate any person, or
- use the Site in a way that harms others or our business.
14. INTELLECTUAL PROPERTY
14.1 All content on the Site (including text, graphics, logos and images) is owned by or licensed to us and is protected by intellectual property laws.
14.2 You may view and use the Site for personal, non-commercial use only. You must not reproduce or distribute Site content without our prior written permission.
15. DISCLAIMER
15.1 We aim to provide a reliable Site, but we do not guarantee uninterrupted access or that the Site will be error-free.
15.2 To the extent permitted by law, Products and services are provided “as is” and “as available”, and we exclude implied warranties except where they cannot be excluded under the ACL.
16. LIMITATION OF LIABILITY
16.1 ACL carve-out: Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the ACL or other applicable laws that cannot be excluded.
16.2 To the extent permitted by law, we are not liable for indirect or consequential loss (including loss of profit, loss of data, or business interruption) arising from your use of the Site or purchase/use of Products.
16.3 Where liability cannot be excluded but can be limited, our liability is limited (at our option) to:
- replacement of the goods or supply of equivalent goods;
- repair of the goods;
- payment of the cost of replacing the goods or acquiring equivalent goods; or
- payment of the cost of having the goods repaired.
17. INDEMNITY
You agree to indemnify us for losses, damages, and reasonable legal costs arising from your breach of these Terms, unlawful conduct, or infringement of third-party rights, except to the extent caused by our negligence or breach of law.
18. CHANGES TO THE SITE OR THESE TERMS
18.1 We may update these Terms from time to time. The updated version will be posted on the Site with a new “Last updated” date.
18.2 If a change is material and affects existing Subscriptions or ongoing services, we will take reasonable steps to notify you (for example by email and/or account notification) before it takes effect, where practicable.
18.3 Changes generally apply prospectively (from the updated date) and do not affect orders already accepted, except where required by law or necessary to address security, fraud prevention, or operational issues.
19. TERMINATION
19.1 You may stop using the Site at any time.
19.2 We may suspend or terminate your access to the Site if we reasonably believe you have breached these Terms.
19.3 Obligations that by their nature should survive termination (including payment obligations, indemnities, and IP clauses) survive termination.
20. SEVERABILITY
If any clause is unlawful or unenforceable, it is severed to the extent necessary and the remainder continues in effect.
21. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
